I used to work ad-hoc in Civil Enforcement/Debt Collection and can assure you that there are many debt collection companies that will take on debts for any amount...large or small...and the success rate is high.

The company that I worked for once chased a debt for £1.25...and it was paid...the fee charged??? 10%...but that only took one letter. Most will take on debts on a no win no fee basis.

If someone owes a sum of money...I think it used to be over £750, then it is possible to take insolvency action against them (speak to a lawyer about this)....the threat of this often scares the living daylights out of them..especially if they own a house, etc. It is far more serious than a County Court Judgement.

The County Court is good with regard to getting a County Court Judgement against debtors, it is cheap and quick...and it will have an adverse affect on the persons credit rating for 6 years, making it akward to obtain mortgages, credit, bank accounts, etc. If this guy utilises a trade account to buy stock etc then this option could cause him problems!

If he does not pay, as ordered by the Judge, then you could obtain a Warrant of Execution which allows the bailiffs to take action. If yu go down this route then my best advice is to use a bailiff that is not employed directly by the court...as the court ones, in my experience...can be...a little too soft!!!

I would give this site a read: http://www.viacorp.com/DebtBook.html#innocent

Although some of the statues that are referenced apply only to the USA, most of the principiles discussed are universal.

For the best book out there on high security locks and their operation, take a look at amazon.com for High-Security Mechanical Locks An Encyclopedic Reference. Written by our very own site member Greyman! A true 5 Star read!!

With a name like that I was hoping for more than bailiffs, someing a little more... permanenet.

ownership

Postby CaptB » 19 Jun 2006 20:05

Does he have ownership of anything you know of??

I know people who have sold businesses to theyre other half for £1.00 then gone bankrupt and the business is still trading from the same place with the same employees but now work for the wife instead of the husband. The husband owes over 25k alone for national insurance. Paying it off at £3.00 per week as he now takes a salary from his wife.
Everything of value is now owned by his wife and there is nothing even the courts can do about it.

Personally if i knew where he lived I would just make his life a living nightmare.. until he paid up. Pay kids to steal his wheels off his van etc..
Thats what I would do but in noway advise anyone else to do the same as me..(for legal reasons).

Had a case many years ago for an extension on a nursecall and firealarm system. £1500 I was owed and it took over 2 months to get it, he settled out of court. But only by force. The property was a care home for the elderly, and generally if im doing any work on a building if I notice any infractions of H&S or fire reg breaches I add them to a seperate sheet and pass them to the people in charge just to make them aware of the faults. (not to fussed if they fix them just make them aware of them).
In this case it worked in my favour... after 2 weeks of chasing i made a call to Enviromental health, Social Services, Local Fire Officer and several other contacts.. Which in turn went through all the faults I had found and many more.. the moral of the story being he paid up to get me to shut up.
Odd thing is several weeks later the guy dropped dead from a heart attack.

The job was a refused payment rather than a delayed payer.. Refused because he only wanted to pay £300.00 which was madness when the parts at cost were around £900.00

We live and learn.
