Handcuff legality question

Having read the FAQ's you are still unfulfilled and seek more enlightenment, so post your general lock picking questions here.

yeah, im familiar with the cop thing. but usually thats with dodgy things right? i mean, like if i asked him about lock picks, i wouldnt even bother, as they dont know jack about that, so they say whatever.

but handcuffs........... i think it might work.

anyway, i tried googling this for about 15 minutes before i posted here, and all i could find were australian laws strangely. so if anyone else can find papers saying one thing or another, id gladly read em.

yeah, thanks james. that WAS helpful.

from what i can tell, it says its only illegal to own handcuff keys if you have been charged with a crime and its on your record, etc.

otherwise you're good.

I may be wrong here but I believe that is just a new law being considered by the 2007 legislative session. To see all the laws that pertain to handcuffs you'd have to go to the current revised statutes for Oregon.

In my experience it is usually a mistake asking cops about the law. They often know very little about the law and have little problem bending the truth to suit what they think should be the law. I mean, go ahead and ask your school police officer what he thinks but take it with a grain of salt.

Most states have internet law references now. I would go straight to the source.

I was agreeing with Sesame.

He is right. Most LEOs are not familiar with all of the laws. This is true when it comes to Firearms restrictions as well.

I would say that if you ask your School RO about cuffs and keys he is going to take some extra interest in you. That is not a good thing these days.

If you are interested in the laws pertaining to cuffs in your state look them up.

SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

Creates crime of unlawful possession of handcuff key. Punishes
by maximum of five years' imprisonment, $125,000 fine, or both.

A BILL FOR AN ACT
Relating to crime; creating new provisions; and amending ORS
131.602.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) As used in this section, 'misdemeanor
involving violence' has the meaning given that term in ORS
166.470.
(2) A person commits the crime of unlawful possession of a
handcuff key if the person:
(a) Has been convicted of a felony or misdemeanor involving
violence under the law of any state or the United States; and
(b) Knowingly is in possession or control of a key that is
capable of unlocking handcuffs used by a law enforcement agency,
as defined in ORS 181.010, or a corrections agency.
(3) Unlawful possession of a handcuff key is a Class C felony.

(4) For purposes of subsection (2) of this section, a person
who has been found to be within the jurisdiction of a juvenile
court for having committed an act that would constitute a felony
or misdemeanor involving violence has been convicted of a felony
or misdemeanor involving violence. + }

That law sucks. Way to make every indie rocker in the state of Oregon a felon. Handcuff keys are a fashion accessory in the 15-21 crowd. As if we don't have enough unemployed meth cooks and food stamp collectors in this state.

that text looked bad actually, im not a felon, i have the cleanest record, which only means ive never lived........

but it looks like (according to that) that if you know it can open a LEO's cuffs, and you know it, then its illegal.

did i miss read that?

and TOWCH. LOL. yeah, too many meth cooks and way too many FS collectors. i used to work at a pizza place that took them, and i would see women walk in and theyd be wearing all like brand name everything, and they look hella expensive, and then they hand me a oregon trail card. WTF? some people actually use it for good.

just go to the dildostore and ask for the pink fur, tell you need replacement fur and this will send the questions off in the other direction if asked by the thought police.

The way I understand what was posted the keyword is AND between sections A and B. If you are a felon and posess a handcuff key, it is illegal.
