Definitely. If that was me, I'd wipe it down, and get rid of it. Nothing is worth a murder charge (or even unlawful possession). 
Some things may be pick proof, but everything can be bypassed....

Same thing happened here, the roofers for my house left a crane here, so I just decided to keep it. No big deal.
