Dual cylinder Deadlatch

Postby noll-security » 21 Mar 2014 22:05

Hi all,

I'm James and I have a customer in California who has what looks like a Prime-Line dead latch. It is dual cylinder made by Craftsman (OEM from Prime line??).
Here in California it is illegal to install one of these (Dual Cylinders) in a residence. My question is: If the customer has one of these in place, am i required to tell them of the legality of it? He says the front rim lock portion doesn't work (I tried it, it doesn't work.) I already told him it might be illegal for him yo have it on his door.

Keep in mind that I am not a lawyer, nor do I pretend to be. That said, in most municipalities that I am aware of, if the lock was installed on his residence before the law was passed, it would fall under the grandfather clause. He can get the lock repaired, but if it is replaced, it would most likely need to be upgraded to meet current building code.

In most jurisdictions it is only illegal if the lock in question is fitted to a "primary" entrance door, like the front or back door. A double cylinder lock can be used on a Patio door or secondary door. As to onus of responsibility, I think it is in your best interest to inform the customer of life safety codes and ask them how they will get out in an emergency.

The other convincing argument you might use is, Insurance companies will look for any reason to deny a claim. If you use a double cylinder lock on a door, have an insurance claim and the insurance company inspector of adjuster finds that you havent complied with life safety codes, they could be within their rights to deny your claim. For the sake of a $45.00 lock, is it worth taking the chance to be denied by the insurance company?

I would advise him to check with the local housing office at city hall and ask THEM. Further, I would put down on the invoice that you advised him thus, have him sign it and keep a copy.

I would get all scared that I was gonna have the cuty take away my locksmith license--Oh wait,
I'm in AZ where it is a right to work state & I am soo glad.
Here we just go ahead and take the money while trying to make the client happy.

Soo much nicer than worrying if the Home depot down the street is licensed to rekey all those locks
