i have a costumer at a cell phone store that wanted me to get him a pizza merchandiser ( heated glass cabinet) to sell my slices out of. there is a 100 employees next store to him so i wasn't going to say no. OK i just got the display unit in. i want him to sign something stating it's my Peace of equipment and if he doesn't sell my product i take it back. what kind of form do i make out its not renting and its not leasing. what would i head the contract with. who fixes it if it breaks. every other place i have worked at never did this so i have no experience. i like the guy to so i dont want to be crude with him. what do you guys think. no hand shake deal right.

Well you draw up a contract, and have a lawer do it at that,

It must state the terms youve agreed on and you must both sign it with witness's,

Business is business, he will understand such a proceedure has to be done,

Make sure it states who owns the equipment and who cleans it, i suggest you stipulate a qualified electrician services it if it goes faulty that way you cant be blamed for burning his shop down,

You also state that its for your products and your products only,

You should also state what cut from the PROFIT he gets, expenses must always be paid first,

You should also state in what conditions the food is to be served, he will be a representative of your food dont forget so it needs to be handled right and not have dirty hands all over it and/or mouldy, hygene precautions must be made as in they must wash their hands before serving etc,

Ive no experiance but thats the route i would go down,

You need to seek proper legal advice and not the opinion of a piking forum as if things goe wrong you will be the one out of pocket and we wont care (I dont mean that litery but you know what i mean)

you made some good points i didn't think about. electrical fire, condition of food and who cleans it. i was going to try to find an out line online and do it myself. just that fire thing and somebody getting sick from eating really old pizza from a dirty display cabinet. just those two made me change my mind. my lawyer must love me I'm always calling for something. you got me thinking on the right track thanks. :)

There are other issues besides. This guy is a cellphone retailer. He is not trained or authorized to sell food pruduct. He doesn't have a food permit. He doesn't meet fire code. He doesn't meet health inspection.

There is a LOT more involved in handling food than putting on rubber gloves and ringing the customer for 2 slices.

Even if you could pull this off. Would you REALLY want to be running to his cellphone store/booth every 60 minutes to bring new pizza slices and throw out the old? You do throw away your pizza after it sits out for 60~90 minutes, right?

you are making total sence. but in buffalo every gas station, corner store candy stand , news stand you name it there all doing it. they mostly belong to la nova's may i say there very good and there nice people to. i dont want to swim with the fish. but the law here is as long as the food is cooked off at a place with a lisense its ok. wow i was pumped i am deflated. i should give him sole responsibility rent to own. after 500 pies it yours.

o an the unsold pizza is his dinner. not mine no way i'd just get a hot dog cart if i was doing it that way.lol

The other side of it is the liability, what if someone manages to burn themselves on the glass case??

Totally agree with shrub get a lawyer to do the paperwork. A lot cheaper than a liability case.

Have you got a catering kitchen to prepare the food prior to deliver to the cabinet? As this will have to abide by your local legislation.

Also if someone does burn themselves even though the unit is being used by someone else, there is always a chance of third party liability.
