Oh Andy, I was expecting so much better from you, you'd obviously not had a tipple before you posted.

ACL

ON what grounds did they justify taking Tax at source?

This can only be done to a Construction company, and Locksmiths do not fall within the construcion Industry.

The national locksmith companies insist on you having a cis card and you
have to get that from your local tax office. I worked like that for years and
it seems that locksmiths do come under the construction industry scheme.

Locksmiths do not come under the construction scheme, unless they carry out other types of work as well, that would be deemed as "construction work".
Locksmiths are classified as being in the manufacturing industry, sub division, Lock and hinge manufacture.
I have over the years had this challenged by numerous organisations including 2 local authorities who have all checked with the Inland Revenue
and had to concede that locksmiths do not come under the CIS scheme.
Some national companies do insist on ALL SUB-CONTRACTORS having a CIS card because it is easier fior them to have everyone on the same system, but it is by no means a legal requirement.

I had to get a cis card after doing a job for the local council, goverment guidelines mean they cannot pay you without one if you do any work on the structure of a building ie doors etc as you fall under the CIS scheme. I did work on some doors and fitted a safe, they were able to pay for the safe job as i included fitting in the price but i had to wait for payment on the doors a they needed a cis card to tax me from and issue the voucher. Now if i had only say sold them a lock with free fitting i would have got paid straight away as its only the labour they deduct from, work that out ? They were very clear on this and its the goverment telling them to do this but no doubt it completely goes against what the inland revenue are saying, which would be typical of this governments love of making things complicated and unworkable.

I agree about the government guidelines and council policies, the same applied to me but I held my ground and insisted that they checked with the IR and after doing so both councils now pay my invoices without stopping Tax.
There are wider implications to CIS working as you are in effect saying that you are part of the construction industry and as such then come under the stringent Health and Safety Laws that are Construction specific and a larger locksmiths company would become legally obliged to pay a percentage of their turnover to the Construction Industry Training Board in the form of a levy etc.
